Meaning and Definition of Contingent Contracts सांयोगिक संविदे (अनुबन्ध) का अर्थ एवं परिभाषा सांयोगिक संविदा; ऐसी संविदा की आनुषंगिक (collateral) किसी घटना के होने या न होने पर किसी बात को करने या न करने की संविदा है। उदाहरणार्थ- सामान्य बीम कम्पनी ‘अ’ के मकान पर चोरी के खिलाफ (Insurance against Theft) बीमा करती है, अर्थात बीमा कम्पनी द्वारा ‘अ’ को राशि देने का प्रश्न उसी दशा में उत्पन्न होता है, जबकि ‘अ’ के मकान में चोरी हो जाए। इस प्रकार सांयोगिक संविदे किसी अनिश्चित भावी घटना के किसी नियत समय में होने अथवा न होने पर ही निर्भर करते हैं, और इस शर्त के पूरा होने पर ही उन्हें प्रवर्तित कराया जा सकता है। ऐसे सांयोगिक संविदे जो किसी असम्भव घटना के घटित होने पर निर्भर करें वे ‘व्यर्थ’ कहलाते हैं। धारा 31के अनुसार, “सांयोगिक अनुबन्ध किसी कार्य को करने अथवा न करने का एक ऐसा अनुबन्ध है, जो कि किसी ऐसी घटना के होने या न होने पर निर्भर है जो कि अनुबन्ध के समपार्रिवक है।’ इस प्रकार सांयोगिक अनुबन्ध – (i) किसी घटना के होने पर किसी कार्य को करने अथवा न करने के लिए अथवा (ii) किसी घटना के न होने पर किसी कार्य को करने अथवा न करने के लिए हो सकता है। ऐसे अनुबन्धों को शर्तयक्त अनुबन्ध कहा जाता है क्योंकि ऐसे अनुबन्धों में दायित्व किसी घटना के होने या न होने की शर्त पर निर्भर करता है। उदाहरणार्थ— ‘अ’, ‘ब’ को उसके मकान में आग लग जाने की शर्त पर ₹ 1,00,000 देने का अनुबन्ध करता है। यहाँ किसी घटना के होने पर किसी कार्य को करने का ‘सांयोगिक अनुबन्ध’ है।
